The drafting and negotiation of international contracts is another important activity of our law firm. Internal (national) rights do not accompany the widespread dissemination of clauses, expressions and acronyms typical of international trade. That is why international conventions appear that establish a complex of alternative rules that regulate international trade relations more effectively.

To this end, Advocacia Arthur Delgado is able to analyze the contracts for the purchase and sale of goods, agency, representation, distribution, service provision, technology transfer, “know how”, “licensing”, “leasing”, “franchising”, “joint venture”, etc.

The commercial defense of companies at (i) national level - with DECOM - Department of Commercial Defense, (ii) regional - Mercosur and (iii) international - World Trade Organization is an area of Law still little explored in Brazil, and in which we also have experience. We act in defense of national companies at three levels, in cases of violation of international trade rules, such as: in cases of "dumping"; subsidies and compensatory measures; as well as advising foreign companies in cases of abusive commercial practices, in the administrative and judicial spheres, in Brazil.

We also advise on matters affecting foreign trade, such as: trade defense measures; barriers to entry of products; tariff preferences and origin regime, among others. We operate in the administrative sphere, with the Secretariat of Foreign Trade (SECEX), the Department of Commercial Defense (DECOM) and other competent bodies, as well as in the judicial sphere.

With the support of our correspondent law offices, we are also able to assist our clients in cases involving restrictions on Brazilian exports or questioning of national legislation, processed before foreign administrative or judicial bodies, or in the WTO dispute settlement system.

Finally, we also offer services related to monitoring the negotiations of international trade agreements for associations and government agencies.

There is no doubt that the contract is an agreement of two or more parties, in which the will of the parties is presented in accordance with the legal system. This instrument aims to establish a regulation of interests between the parties, with the objective of acquiring, modifying or extinguishing legal relationships. These are issues that have already been overcome.

The contract must be thoroughly prepared, according to each specific case, covering all the needs of the parties, as well as the link established by the legal terms.
